Filming on Museum premises
Permission to reproduce images from the Collections of the Ulster Museum in any form is dependent on full acceptance of the following Terms and Conditions and is automatically withdrawn if any part is infringed.
All photographic materials required for reproduction purposes must be obtained from the Ulster Museum Picture Library.
Supply of Pictures
1 The Ulster Museum operates a Pro-Forma invoicing system and payment must be received before materials and permission for reproduction can be sent.
2 Colour transparencies are hired for 3 calendar months at current prices whether they are used or not.
3 Black and white prints are sold at current prices.
4 The applicant agrees to indemnify the Ulster Museum in respect of any claims or damages or any loss or costs arising in any manner from the reproduction without proper reproduction rights of any picture supplied by the Ulster Museum.
5 The Ulster Museum shall not be liable for any loss or damage suffered by the applicant or by any third party arising from the use of any picture or its caption.
Application
1 All communications connected with the reproduction of works from the Collections must be addressed to the Ulster Museum Picture Library, Ulster Folk and Transport Museum, Cultra, Holywood, County Down, BT18 0EU.
2 Requests for permission to reproduce works from the Collections are considered only on receipt of the completed, signed and dated Application/Reproduction Form.
Payment
1 Payment should be made within 30 days of invoicing. All bank charges must be borne by the payee - goods may not be sent if payment is not received in full.
2 Cheques should be made payable to National Museums Northern Ireland, in UK Pounds Sterling.
3 Permission to reproduce works from the Collections will not be granted until the reproduction fee payable has been agreed.
Colour Transparency/CD Hire
1 Arrangement to hire a image is subject to its availability. Clients will be charged if new photography is required, or the urgency of the request requires a new duplicate transparency to be made.
2 Applicants should note the date of return for the hired transparency/CD. Transparencies/CDs are hired for 3 calendar months from the date of dispatch from the Museum. Late return will attract an additional fee of £2.50 per week.
3 If a reminder letter is raised for the late return of a transparency/CD an additional administration fee of £10.00 + VAT for the first letter and £5.00 + VAT for each subsequent letter will be charged.
4 Transparencies must be carefully handled. They are easily damaged by fingerprints and exposure to heat and light. They must be returned undamaged, in the correct pockets and free from any substance used to prevent slippage during scanning.
5 A replacement fee of £100.00 + VAT will be charged for each transparency lost or damaged. A fee of £50.00 + VAT will be charged for each CD lost or damaged.
6 It is strictly prohibited to reproduce from 35mm slides, or from any reproduction in books, or from other copies of works from the Collections for reasons of copyright and quality.
7 It is strictly prohibited to make duplicates of any transparencies/CDs supplied by the Museum.
8 The Museum reserves copyright on all slides, transparencies and digital images supplied.
9 Transparencies/CDs hired from the Museum are not to be lent, re-sold, hired out, licensed or otherwise circulated to any other party/parties without prior permission from the Museum.
10 Electronic/digital use, storage, or transmission of images is strictly prohibited without the express written permission of the Museum.
11 All images scanned for printing purposes must be removed from the system after the usage/s on the Application Form/Reproduction Form is complete.
12 Scanned images must not be re-used without prior permission from the Museum.
Reproduction
1 Permission to reproduce images from the Collections, and the fees payable, cover only the specific usage detailed on the Application/Reproduction Form. All additional usages, including reprints or new editions, require separate permission application.
2 Black and white reproductions must only be made from photographs supplied by the Museum. The prints are sold and need not be returned. However, all rights in the prints remain the property of the Museum and they may not be reproduced in any way without permission from the Museum.
3 It is strictly prohibited to re-photograph or make new negatives from any black and white prints supplied for any purpose.
4 The images supplied must not be cropped, masked out, superimposed with type or in any way defaced or manipulated without prior permission from the Museum.
5 Application to reproduce a detail from a work, or a cropped image, will only be considered upon receipt of a sketch or marked-up mock-up, showing the detail to be reproduced. The caption must include the word "detail".
6 Possession of a print or transparency or digital image does not carry with it any rights to reproduce. Application must be made on the form provided. Permission will only be granted on agreement of the relevant fees and approval of the proof/design layout, if requested.
7 The reproduction must include the acknowledgement, Photograph reproduced courtesy the Trustees of National Museums Northern Ireland, along with the name and dates of the creator and the title and date of the work, or the details on the caption supplied. Credits should be included in the caption, if possible, or in the photographic credits or, in the case of film or video, in the opening or closing credits. If the full acknowledgement cannot be fitted in, please contact the Ulster Museum Picture Library for advice.
8 It is understood that it is the responsibility of the user of any copyright images to ensure that they have permission from the copyright owner before reproduction takes place. For information, the copyright term lasts for the lifetime of the creator, plus 70 years from the date of death. This permission is separate to the permission given by the Museum, and is required by Law under the Copyright Design and Patents Act 1988 and the EEC Directive 93/98.
9 A proof of the reproduction and any accompanying copy must be submitted to the Museum, if requested, prior to publication. Failure to submit accurate proofs can result in costly correction having to be made and withdrawal of reproduction permission.
10 A copy of each publication should be forwarded to the Ulster Museum Picture Library on publication for record purposes.
11 It is strictly prohibited to store images on any digital, electronic or computerised device now available or yet to be invented. All usages of this nature must have prior permission from the Museum.
12 All images scanned for printing purposes must be removed from the system after the usage on the Application/Reproduction Form is complete. Scanned images must not be used without prior permission from the Museum.
Filming on Museum Premises
1 Applications for permission to use the premises of the Ulster Museum for a filming location, or to film works of art or other specimens from the Collections of the Ulster Museum, follow the same general procedure as with 'still' reproductions. A synopsis of the film or programme will be requested. Applicants will be bound by the same regulations governing all other forms of reproduction, but particularly those in the contract between the applicant and the Museum which will be raised and agreed prior to the date filming takes place.
2 A facility fee for filming on the premises will be charged at current rates, plus a transmission fee which will be calculated on a per second basis for the final edited footage to be used and will be based on the rights requested and territory of distribution.
3 The agreed acknowledgement should appear in the opening or closing credits.
4 Copyright, where applicable, must be cleared before filming can take place. This must be in writing. The Museum will require sight of permission letter/s before filming can commence.
5 The applicant/production company carrying out the filming must adhere to current health and safety regulations regarding the equipment/gear being used by them.
6 The applicant/production company accepts full responsibility for any damage to life or property consequential to the filming.
7 Prior to filming, all electrical power and lighting requirements must be discussed with relevant Museum staff.
8 The Museum will take no responsibility for any loss or damage to any equipment/gear belonging to the applicant/production company, or any personal possessions of the crew/participants while on Museum property.
General Conditions of Use
1 The Museum reserves the right to refuse permission for further applications from an applicant if, in our opinion, the standard of reproduction has not been of sufficiently high quality.
2 Reproduction without permission, inadequate acknowledgements, or any breach of copyright law, will result in a minimum fee of £100.00 per image as compensation, in addition to any other fees due. If a breach of copyright merits legal action, this will be taken.
3 All images scanned for printing purposes must be removed from the system after the usage on the Application/Reproduction Form is complete. Scanned images must not be used without prior permission from the Ulster Museum.
4 Rights to store, transmit or reproduce images in electronic/digital form, on or by any device now available or yet to be invented, must always be negotiated separately.
Unauthorised photography on or in Museum premises is strictly prohibited.
